Make Web Not War – VIA Rail Transportation
Terms & Conditions
Please review these terms and conditions (the “T&Cs”) between you and Microsoft Canada Inc. (“Microsoft Canada”) regarding the purchase of a round-trip ticket for VIA Rail transportation between Toronto and Montreal for the Make Web Not War 2010 conference in Montreal, QC on May 27th, 2010 (the “MWNW Conference”). By purchasing a ticket, you agree to these T&Cs.
Ticket Description and Availability
- There are 50 round-trip tickets available for purchase on a first come, first served basis.
- You must be registered to attend the MWNW conference to purchase a ticket. (Register online)
- Toronto (Union Station) to Montreal (Central Station):
- Departure: May 25th, 2010, 9:30 AM | Arrival: 2:42 PM
- Meeting Time: 8:30AM outside of the VIA Rail Panorama Lounge
- Toronto (Union Station) to Montreal (Central Station):
- Montreal (Central Station) to Toronto (Union Station):
- Departure: May 28th, 2010, 11:35 AM | Arrival: 5:02 PM
- Meeting Time: 11:00AM outside of VIA Rail Lounge Panoramic
- Cost of the ticket is $50.00 Canadian dollars (CAD) (including GST) and includes: VIA Rail transportation from Toronto, ON to Montreal, QC; return VIA Rail transportation from Montreal, QC to Toronto, ON, one boxed meal on the train each way; and WiFi & Power access. All other travel, accommodation and living expenses are at your cost, including transportation to and from the train stations in both Toronto and Montreal, and to and from the conference venue.
- Train tickets are valid only on the following dates:
Representations and Warranties
You hereby represent and warrant that you:
- are purchasing the ticket and attending the MWNW Conference for business reasons, and not for personal, family or household purposes;
- are 18 years of age or older; and
- have a valid credit card.
How To Purchase Your Ticket
- Once you have registered for the MWNW Conference online, send an email to cdnsol@microsoft.com and express your interest in purchasing a ticket.
- Only one (1) ticket per person will be available.
- Once your email is received, if there are tickets available, you will receive a response email with instructions on how to make your payment. You must make payment within 48 hours of receipt of the email, after which the ticket allocated to you will be offered to the next person in line.
- Transactions will be processed in 3-4 business days and you will receive your receipt by email.
- Payments will be collected by Starshot Ventures Inc. on behalf of Microsoft Canada.
- Tickets are to be picked up outside the VIA Rail Panorma Lounge at Union Station in Toronto on the departure date meeting time.
- ID and proof of payment will be required to receive your ticket.
Travel Services
- Use of the travel services, which are provided by VIA Rail, is subject to any terms and conditions established by VIA Rail.
- Any special needs requirements must be made directly with VIA Rail 48 hours or more in advance of the travel time at 1 888 VIA-RAIL (1 888 842-7245).
- Any special dietary requirements must be submitted at least 48 hours ahead of travel time by email to erika@starshot.com.
- Seating on the train is on a first come, first served basis at the train station.
- You acknowledge that the travel services are provided by VIA Rail, and that you hereby release and discharge Microsoft Canada, to the fullest extent permitted by law, from any and all claims, suits, costs, demands, damages, actions or causes of action whatsoever, including without limitation, liability for personal injury, death, or other injury or accident directly or indirectly related to or arising from such travel services, including the meal provided.
Additional Terms & Conditions
- Microsoft Canada is not responsible for making alternate travel arrangements in the event that you miss the train, and/or the train does not leave as scheduled for any reason.
- Microsoft Canada will not be responsible for delays caused by breakdowns, track conditions, weather or other conditions beyond the carrier’s control.
- Microsoft Canada will not be responsible for lost or stolen tickets.
- You acknowledge that Microsoft Canada has not arranged for and does not carry insurance of any kind for your benefit; and that you are solely responsible for obtaining and paying for any life, travel, accident, property or other insurance relative to the travel services, should you desire it.
- Tickets are non-refundable and non-transferable. If a ticket is presented for transportation by any person other than the original purchaser, it will be void and will be confiscated.
- Microsoft Canada assumes no responsibility for any (i) late, lost, delayed, not received, damaged, misdirected, or incomplete registrations, emails, and/or payment; (ii) failure to receive registrations, emails, and/or payment due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient or traffic congestion on the Internet or at any web site.
- The parties have expressly requested and required that these terms and conditions of sale and all other related documents be drawn up in the English language. Les parties conviennent et exigent expressément que ces conditions de vente et tous les documents qui s’y rapportent soient rédigés en anglais.
- These T&Cs and any document referenced herein represent the entire agreement between us in relation to the sale and use of the tickets and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. Neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us except as expressly stated in these T&Cs.
- These T&Cs apply to the greatest extent permitted by law and unless restricted or prohibited by law. You may have greater rights in your jurisdiction of residence which these terms of use cannot change. If any of these terms of sale or any provisions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
- To the extent permitted by law and unless restricted or prohibited by law, these T&Cs will be governed by the law of Ontario.
